Client certifies that Client voluntarily assumes all risks of physical injury, whether minor, severe, or otherwise, that may occur during the length of the program. Client acknowledges that participation in fitness training, exercise programs, and nutritional changes involves inherent risks.
Client certifies that Client will not hold MJB ELITE HEALTH or its Trainer(s), coaches, contractors, or representatives liable for any physical injury, illness, or condition, whether minor, severe, or otherwise, that may result from participation in the program.
Client certifies that Client assumes full responsibility for Client’s participation, decisions, actions, and results throughout the duration of the program. Client agrees to consult with a qualified medical professional prior to beginning the program and to disclose any relevant medical conditions, injuries, or limitations.
MJB ELITE HEALTH will provide a customized coaching plan designed to help the Client pursue their stated health and fitness goals. Services may include, but are not limited to:
MJB ELITE HEALTH does not provide medical advice, diagnosis, or treatment. All services are coaching- and education-based in nature.
The Client agrees to indemnify and hold harmless MJB ELITE HEALTH and its Trainer(s), coaches, contractors, and representatives from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to the Client’s participation in the program.
The Client acknowledges that this is a results-based coaching program requiring a full six (6) month commitment. Early termination, suspension, or withdrawal from the program by the Client is not permitted prior to completion of the full six (6) month term, except as expressly stated in this section.
To be eligible for any consideration under this Termination provision, the Client must demonstrate good-faith participation throughout the entire six (6) month program, including but not limited to:
Failure to reasonably adhere to the program structure, maintain communication, or implement the coaching guidance provided may void eligibility for any refund or remedy under this section.
MJB ELITE HEALTH agrees to provide:
MJB ELITE HEALTH does not guarantee specific results, as outcomes depend on individual effort, consistency, health history, lifestyle factors, and adherence to the program.
The Client may request termination only after completion of the full six (6) month program. If, after completing the program and fully complying with all reasonable coaching requirements, the Client has not achieved the specific, mutually agreed-upon primary goal, the Client may request a refund of up to one hundred percent (100%) of the total program cost.
Any approved refund shall be issued at the sole discretion of MJB ELITE HEALTH and may be distributed back to the Client in monthly installments rather than a lump-sum payment.
No refunds, partial refunds, or chargebacks will be issued for early termination, missed sessions, lack of participation, changes in personal circumstances, illness, travel, scheduling conflicts, dissatisfaction, or circumstances outside of MJB ELITE HEALTH’s control.
MJB ELITE HEALTH reserves the right to terminate this agreement at its sole discretion if the Client:
In such cases, no refund will be issued, and any outstanding balance shall remain due.
This document reflects the entire agreement between the Parties and constitutes a complete understanding of the Parties with respect to the subject matter. This Contract may not be amended, altered, or supplemented except in writing signed by both MJB ELITE HEALTH and the Client.
This Contract is legal and binding upon execution by both Parties and is enforceable in accordance with applicable laws of the United States.
The failure of either Party to enforce any provision of this Contract shall not be deemed a waiver of that Party’s right to subsequently enforce and compel strict compliance with every provision.
This Contract shall be governed and construed in accordance with the laws of the state in which the training services are provided, without regard to conflict of law principles.
THE CLIENT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO ALL TERMS AND CONDITIONS CONTAINED IN THIS CONTRACT AND ENTER INTO THIS AGREEMENT VOLUNTARILY.
